Welcome to SmartAkant (“SmartAkant,” “we,” “our,” or “us”). These Terms and Conditions govern your access to and use of the SmartAkant website, applications, and services.
By accessing or using SmartAkant, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
1. Definitions
- “Platform” refers to the SmartAkant website, applications, and software services.
- “Company” refers to any business or organization registered on SmartAkant.
- “User” refers to any person authorized to access a company’s workspace.
- “Subscription” means the paid service plan provided by SmartAkant.
- “Free Trial” means the initial thirty (30) day access period provided to new customers.
2. Eligibility
To use SmartAkant, you must:
- Be at least 18 years old.
- Have the legal authority to represent your business or organization.
- Provide accurate and complete registration information.
3. Account Registration
To use SmartAkant, a company account must be created.
During registration, you may be required to provide:
- Company Name
- Business Address
- Email Address
- Phone Number
- Other information necessary to provide our services.
You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
4. Thirty (30) Day Free Trial
Every newly registered company is entitled to a free trial period of thirty (30) days.
During the trial period:
- You will have access to the features included in your selected plan.
- No payment information is required unless otherwise stated.
- SmartAkant reserves the right to limit certain premium features during the trial period.
At the end of the thirty (30) day free trial, you must subscribe to a paid plan to continue using the platform.
5. Subscription and Renewal
Continued access to SmartAkant requires an active subscription.
Subscriptions may be:
- Monthly
- Quarterly
- Annually
- Or any other plan offered by SmartAkant.
Subscription fees are payable in advance and are non-refundable except where required by law.
6. Suspension for Non-Renewal
If your subscription expires and is not renewed:
- Your company account may be automatically suspended.
- Access to your workspace, reports, and data may be restricted.
- Users may be unable to log in until the subscription is renewed.
SmartAkant reserves the right to suspend accounts immediately after the expiration of a trial or paid subscription without renewal.
7. Account Deletion After Sixty (60) Days
If a suspended account remains unpaid and inactive for sixty (60) consecutive days after suspension, SmartAkant reserves the right to:
- Permanently delete the company account;
- Permanently delete all associated data, including:
- Accounting records
- Sales records
- Inventory records
- Payroll data
- Customer and supplier information
- Reports and uploaded documents.
Once an account has been deleted, recovery of the data may not be possible.
Customers are strongly encouraged to maintain their own backups of important information.
8. User Responsibilities
You agree to:
- Provide accurate information.
- Maintain the confidentiality of your login credentials.
- Use the platform in compliance with applicable laws.
- Ensure that only authorized persons access your account.
- Maintain backups of critical business information.
9. Acceptable Use
You agree not to:
- Use the platform for unlawful activities.
- Attempt unauthorized access to the system.
- Upload malicious software or harmful code.
- Interfere with the operation of the platform.
- Reverse engineer or attempt to copy the software.
10. Data Ownership
You retain ownership of all business data entered into SmartAkant, including:
- Financial records
- Inventory data
- Employee information
- Customer information
- Reports and documents
SmartAkant does not claim ownership of your business information.
11. Intellectual Property
All software, source code, trademarks, logos, graphics, and content on SmartAkant remain the exclusive property of SmartAkant and its licensors.
No part of the platform may be copied, reproduced, modified, or distributed without prior written consent.
12. Service Availability
While we strive to provide uninterrupted access to the platform, SmartAkant does not guarantee:
- Continuous availability;
- Error-free operation;
- Uninterrupted service.
Scheduled maintenance, upgrades, and unforeseen circumstances may occasionally affect service availability.
13. Data Security
We implement reasonable technical and organizational measures to protect your information, including:
- Encryption
- Password hashing
- Secure authentication
- Role-based access controls
- Activity monitoring
However, no internet-based system can guarantee absolute security.
14. Limitation of Liability
To the fullest extent permitted by law, SmartAkant shall not be liable for:
- Loss of profits
- Loss of revenue
- Loss of business opportunities
- Loss of data
- Indirect or consequential damages arising from the use of the platform.
15. Indemnification
You agree to indemnify and hold harmless SmartAkant, its employees, affiliates, and partners from any claims, damages, or liabilities arising from:
- Your use of the platform;
- Violation of these Terms;
- Violation of applicable laws or regulations.
16. Termination
SmartAkant reserves the right to suspend or terminate your account at any time if:
- You violate these Terms and Conditions;
- You engage in fraudulent or unlawful activities;
- You misuse the platform;
- You fail to renew your subscription within the permitted period.
17. Changes to the Service
We reserve the right to:
- Modify features;
- Introduce new services;
- Change pricing;
- Discontinue features or services.
Reasonable notice will be provided where appropriate.
18. Changes to These Terms
SmartAkant may update these Terms and Conditions from time to time.
Updated versions will be posted on our website and become effective immediately upon publication.
Continued use of the platform constitutes acceptance of the revised Terms.
19. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
